Terms of Service

Effective Date: March 31, 2026

Please read these Terms of Service carefully before using Tunik. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use the Service.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Mogul Living, Inc. ("Company," "we," "us," or "our"), governing your use of the Tunik mobile application ("App") and related services, including our website at tunikstudios.com (collectively, the "Service").

By downloading, installing, creating an account, or otherwise using the App, you confirm that:

  • You are at least 18 years old (or the age of majority in your jurisdiction);
  • You have the legal capacity to enter into this agreement;
  • You are accepting these Terms on behalf of yourself and, where applicable, on behalf of your minor child(ren) who will use the App under your supervision.

Tunik is designed exclusively for use by children ages 3–12 under parental supervision. Only a parent or legal guardian may create and manage an account. Children may not accept these Terms or create accounts themselves.

2. The Service

Tunik is an audio storytelling app that brings Armenian folklore, fairy tales, and epics to life for children. The Service includes:

  • Access to a curated library of narrated audio stories in Armenian, with English and Russian translations available for select metadata
  • Original, professionally produced illustrations accompanying each story
  • Multiple child profile management with age-appropriate content filtering (age bands: 3–5, 5–7, 7–9, 9–12)
  • Offline downloading for listening without an internet connection
  • Playback history, resume functionality, favorites, and personalized story recommendations
  • Parental controls including a parent gate, bedtime reminders, and profile management

2a. Child-Safe Design

Tunik is designed with children's safety as a core principle:

  • No advertisements — The app contains no ads, sponsored content, or promotional materials of any kind.
  • No user-generated content — Children cannot post, upload, share, or communicate with anyone through the app.
  • No social features — There are no chat, messaging, comments, friend lists, or social networking features.
  • No external links accessible to children — Links to external websites or services are only accessible behind the parent gate.
  • No in-app purchase prompts shown to children — Subscription management is gated behind parental verification.
  • Age-appropriate content only — All stories are reviewed for age appropriateness and filtered based on the child's age band set by the parent.

3. Accounts & Parental Responsibility

3a. Account Creation

To use Tunik, you must create an account using your email address (via a secure one-time magic link) or Apple Sign-In. One account is permitted per household. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3b. Child Profiles

You may create one or more child profiles within your account. Each profile includes a display name, age band, and avatar — all set and managed exclusively by you, the parent. You represent and warrant that:

  • You are the parent or legal guardian of each child for whom you create a profile;
  • The age band you select accurately reflects the child's age;
  • You consent to the collection and use of your child's data as described in our Privacy Policy.

3c. Parental Supervision

You acknowledge that you are responsible for supervising your child's use of the App. While we design Tunik to be safe for independent use by children, parental oversight is encouraged, especially for younger age groups (3–5). You are responsible for configuring parental controls (bedtime timers, profile settings) appropriate for your child.

3d. Account Security

You agree to:

  • Keep your account credentials confidential and not share them with anyone, including your children;
  • Not allow others outside your household to use your account;
  • Notify us immediately at support@tunikstudios.com if you suspect unauthorized access to your account.

We are not liable for any loss or damage arising from unauthorized use of your account.

3e. Account Sharing & Household Use

Your Tunik subscription is for personal, non-commercial use within a single household. You may create multiple child profiles for children within your household but may not share your account with individuals outside your household.

4. Subscriptions & Billing

4a. Free & Premium Content

Tunik offers a selection of free stories accessible to all registered users. Access to the full story library, including premium content, requires an active paid subscription.

4b. Subscription Plans

We offer the following auto-renewing subscription plans:

  • Monthly — billed on a recurring monthly basis
  • Annual — billed on a recurring annual basis

Current pricing is displayed in the App and on the Apple App Store prior to purchase. Prices are shown in your local currency as determined by Apple and may vary by region. Pricing may be subject to applicable taxes.

4c. Free Trial

We may offer a free trial period for eligible new subscribers. Key terms:

  • Trial eligibility is determined by Apple and is generally limited to one free trial per Apple ID.
  • During the trial, you have full access to premium content.
  • If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan at the price displayed at the time of sign-up.
  • You may cancel at any time during the trial without charge.
  • The duration of the free trial (if offered) will be disclosed before you confirm your subscription.

4d. Billing & Renewal

All subscriptions are processed and billed exclusively through the Apple App Store. By subscribing, you agree to Apple's applicable payment terms. Important billing details:

  • Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends.
  • Renewal charges are processed by Apple within 24 hours of the end of the current billing period.
  • We do not process, store, or have access to your payment information (credit card numbers, bank details, etc.). All payment processing is handled by Apple.

4e. Cancellation

You may cancel your subscription at any time. To cancel:

  1. Open your device's Settings
  2. Tap your Apple ID (your name at the top)
  3. Tap Subscriptions
  4. Select Tunik and tap Cancel Subscription

Cancellation takes effect at the end of your current billing period — you will retain full access to premium content until then. We do not offer prorated refunds for unused portions of a billing period. Deleting the app does not cancel your subscription.

4f. Refunds

Because billing is handled by Apple, refund requests must be submitted to Apple directly. To request a refund:

  • Visit reportaproblem.apple.com
  • Sign in with your Apple ID
  • Select the Tunik subscription charge and follow the prompts

We will cooperate with Apple's refund process as needed. Refund eligibility is determined by Apple in accordance with their policies and applicable law.

4g. Price Changes

We may change subscription pricing from time to time. If we increase prices:

  • Existing subscribers will be notified by Apple in advance of the change.
  • You will be asked to agree to the new price before it takes effect.
  • If you do not agree to the new price, your subscription will not renew at the higher rate — you may cancel and your access will continue through the end of the current billing period.

4h. Offline Access & Subscription Verification

Downloaded content remains accessible offline for the duration of your active subscription. Your device will periodically verify your subscription status when connected to the internet. If your subscription has expired or been cancelled:

  • Access to premium downloaded content will be revoked upon the next successful verification.
  • Free content and your account data will remain accessible.
  • You may re-subscribe at any time to restore access to premium content.

5. Acceptable Use

You agree to use Tunik only for its intended purpose — personal, non-commercial enjoyment of stories within your household. You agree not to:

  • Share your account credentials with anyone or allow access by individuals outside your household;
  • Attempt to circumvent, disable, or interfere with subscription verification, download protection, content delivery mechanisms, or the parent gate;
  • Copy, record, redistribute, publicly perform, broadcast, or create derivative works from any stories, narrations, illustrations, music, sound effects, or other content from the App;
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any part of the App, except to the extent expressly permitted by applicable law;
  • Use the App for any unlawful, fraudulent, or harmful purpose;
  • Use automated tools, scripts, bots, scrapers, or any other means of automated access to the Service;
  • Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure;
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service;
  • Use the Service to infringe upon the intellectual property rights of any party;
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.

Violation of these restrictions may result in immediate suspension or termination of your account.

6. Intellectual Property

6a. Ownership

All content in Tunik — including but not limited to stories, narrations, voice recordings, scripts, illustrations, artwork, animations, music, sound effects, the Tunik fox character and mascot (in all forms and poses), the Tunik logo, app design, user interface, and underlying software — is owned by or exclusively licensed to Mogul Living, Inc. and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6b. Limited License to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the App on devices that you own or control;
  • Access and stream content through the App for personal, non-commercial enjoyment within your household;
  • Download content for offline listening within the App, subject to your active subscription.

This license does not include the right to:

  • Reproduce, distribute, publicly display, or publicly perform any content outside of the App;
  • Create derivative works based on any content;
  • Use any content for commercial purposes, including in schools, daycare centers, or public venues, without a separate commercial license from us;
  • Sub-license, rent, lease, or lend your access to any third party.

6c. Trademarks

"Tunik," "Tunik Studios," the Tunik fox mascot, and the Tunik logo are trademarks or registered trademarks of Mogul Living, Inc. All other trademarks appearing in the App are the property of their respective owners. You may not use any of our trademarks without prior written permission.

6d. Feedback & Suggestions

If you provide us with feedback, suggestions, story ideas, feature requests, or other submissions ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation to you. You acknowledge that we may already be developing similar ideas independently. Do not send us any Feedback that you consider confidential or proprietary.

6e. Copyright Infringement (DMCA)

We respect the intellectual property rights of others. If you believe that content available through Tunik infringes your copyright, please send a notice to our designated DMCA agent at support@tunikstudios.com with the subject line "DMCA Notice" containing:

  • Identification of the copyrighted work you believe is infringed;
  • Identification of the material in the App you believe is infringing;
  • Your contact information (name, address, email, phone number);
  • A statement that you have a good-faith belief that the use is not authorized;
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner;
  • Your physical or electronic signature.

7. Content & Service Modifications

7a. Content Library

The Tunik story library is a curated, evolving collection. We reserve the right to:

  • Add new stories and content to the library;
  • Remove or modify existing stories (for example, to update narration, correct errors, or improve illustrations);
  • Reclassify the age band or access tier (free/premium) of any story.

We understand that removing content can be disappointing. We will make reasonable efforts to maintain popular stories but cannot guarantee that any specific story will remain available indefinitely.

7b. App & Feature Changes

We continuously improve Tunik and may update, modify, or discontinue features at any time. We will make reasonable efforts to provide advance notice of significant changes that negatively affect your experience.

7c. Price Changes

Subscription pricing may change as described in Section 4g.

8. Service Availability

8a. Uptime

We strive to keep Tunik available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice where practicable);
  • Unscheduled maintenance to address urgent bugs or security issues;
  • Factors beyond our reasonable control (see Section 8b).

Downloaded content remains accessible offline during Service interruptions, subject to subscription verification requirements.

8b. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.

9. Privacy

Your use of Tunik is also governed by our Privacy Policy, which describes how we collect, use, and protect your family's data — including specific protections for children's information under COPPA, GDPR, and other applicable laws. The Privacy Policy is incorporated into these Terms by reference.

By using the Service and creating child profiles, you consent to the collection and use of information as described in the Privacy Policy, including providing verifiable parental consent for the collection of your child's data.

10. Termination

10a. Termination by You

You may stop using the Service at any time. To fully close your account:

  • Cancel your subscription through Apple (see Section 4e) to stop future billing;
  • Delete your account through the App's Parent Settings to permanently remove all your data.

Account deletion permanently and irreversibly removes all associated data — including all child profiles, play history, favorites, downloaded content, and subscription records — within 30 days. This action cannot be undone.

10b. Termination by Us

We may suspend or terminate your account if:

  • You materially violate these Terms (including acceptable use restrictions);
  • You engage in fraudulent activity or abuse the Service;
  • We are required to do so by law, regulation, or court order;
  • Your account has been inactive for more than 24 consecutive months.

Where practicable, we will provide you with advance notice and an opportunity to cure the violation before termination. If we terminate your account without cause, you will receive a prorated refund for any unused portion of your current subscription period.

10c. Effect of Termination

Upon termination:

  • Your license to use the App and access content is immediately revoked;
  • Downloaded premium content will become inaccessible;
  • Sections of these Terms that by their nature should survive termination will continue to apply, including: Intellectual Property (Section 6), Disclaimers (Section 12), Limitation of Liability (Section 13), Indemnification (Section 14), and Dispute Resolution (Section 15).

11. Electronic Communications

By creating an account, you consent to receive electronic communications from us, including:

  • Service-related emails — Account verification, security notices, subscription confirmations, and important service updates. These are transactional and cannot be opted out of while your account is active.
  • Push notifications — New story releases, feature updates, and engagement reminders. You may opt out at any time via your device settings.
  • Marketing communications — Occasional announcements about new features. You may opt out at any time.

You agree that these electronic communications satisfy any legal requirement that communications be in writing.

12. Disclaimers

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components.
  • We do not warrant the accuracy, completeness, or reliability of any content. Stories in Tunik are creative retellings of Armenian folklore and cultural narratives. They may contain artistic interpretations and should not be treated as historical or academic references.
  • We do not warrant that the Service will meet your specific requirements or expectations.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply only to the extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • No indirect damages. Mogul Living, Inc., its officers, directors, employees, affiliates, agents, licensors, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, whether incurred directly or indirectly, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
  • Liability cap. Our total aggregate liability for all claims arising from or relating to these Terms or the Service shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) fifty US dollars ($50.00).
  • Essential purpose. The limitations above apply even if any limited remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Mogul Living, Inc., its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of or access to the Service;
  • Your violation of these Terms;
  • Your violation of any third-party right, including any intellectual property or privacy right;
  • Any claim that your actions caused damage to a third party.

This indemnification obligation will survive termination of these Terms and your use of the Service. Where permitted by law, we will provide you with notice of any such claim and reasonable assistance in your defense.

15. Dispute Resolution

15a. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15b. Informal Resolution First

We want to address your concerns without a formal legal case. Before filing any formal dispute, you agree to contact us at support@tunikstudios.com with the subject line "Dispute" and attempt to resolve the matter informally. We will make good-faith efforts to resolve the dispute within 60 days of receiving your notice.

15c. Binding Arbitration

If the dispute cannot be resolved informally, you and Mogul Living, Inc. agree to resolve it through final and binding individual arbitration rather than in court, except as stated in Section 15e. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, conducted in Los Angeles, California (or, at your election, via phone or video conference).

The arbitrator shall have exclusive authority to resolve all disputes, including the scope and enforceability of this arbitration provision. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

15d. Class Action Waiver

You and Mogul Living, Inc. agree that all disputes will be resolved on an individual basis only. Neither party may participate in a class action, collective action, private attorney general action, or any other representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

15e. Exceptions to Arbitration

Either party may:

  • Bring an individual action in small claims court for disputes within its jurisdiction;
  • Seek injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property rights, unauthorized access, or data security.

15f. Arbitration Fees

If you initiate arbitration, we will pay all AAA filing fees and arbitrator costs that exceed what you would have paid to file a claim in court. We will not seek attorneys' fees from you in arbitration unless the arbitrator finds your claim to be frivolous.

15g. Opt-Out of Arbitration

You may opt out of the arbitration and class action waiver provisions by sending written notice to support@tunikstudios.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out." If you opt out, disputes will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

16. International Users

Tunik is operated from the United States. If you access the Service from outside the United States, you do so at your own initiative and are responsible for compliance with local laws. The following additional terms apply by jurisdiction:

16a. European Economic Area, United Kingdom & Switzerland

If you are a consumer in the EEA, UK, or Switzerland:

  • Nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence, including the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Rights Act 2015.
  • For digital content, you have the right to a remedy (repair, replacement, or refund) if the digital content is not as described, not fit for purpose, or not of satisfactory quality.
  • The limitation of liability and warranty disclaimers in these Terms apply only to the extent permitted under applicable local law.
  • The arbitration clause in Section 15 does not apply to you if it is not enforceable under the laws of your country. Instead, disputes will be resolved in the courts of your country of residence.
  • You may have the right to withdraw from a digital content purchase within 14 days, except where you have expressly consented to immediate performance and acknowledged losing the right of withdrawal.
  • For complaints, you may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16b. Australia

If you are an Australian consumer, nothing in these Terms excludes, restricts, or modifies consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). To the extent permitted, our liability for breach of any non-excludable guarantee is limited to re-supplying the Service or paying the cost of re-supply.

16c. Canada

If you are a Canadian consumer, you may have additional rights under provincial consumer protection legislation that cannot be waived by contract. These Terms do not limit any such rights.

16d. Export Controls

You agree not to export or re-export the App or any content in violation of United States export control laws and regulations, including the Export Administration Regulations (EAR) and Office of Foreign Assets Control (OFAC) sanctions programs. You represent that you are not located in, under the control of, or a national or resident of any country subject to US embargo.

17. Apple App Store Terms

The following terms apply to your use of Tunik as downloaded from the Apple App Store:

  • These Terms are between you and Mogul Living, Inc. only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide any maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
  • In the event of any third-party claim that the App or your use of it infringes a third party's intellectual property rights, Mogul Living, Inc. (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
  • You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and you are not listed on any US government list of prohibited or restricted parties.

18. Accessibility

We are committed to making Tunik accessible to all families. We strive to follow applicable accessibility standards and best practices in our app design. If you encounter any accessibility barriers or have suggestions for improvement, please contact us at support@tunikstudios.com. We will make reasonable efforts to address accessibility concerns promptly.

19. Open-Source Software

The App may contain open-source software components licensed under their own respective terms. A list of open-source licenses used in Tunik is available within the App's settings. Nothing in these Terms limits your rights under, or grants you rights that supersede, the terms of any applicable open-source license.

20. General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mogul Living, Inc. regarding the Service and supersede all prior agreements, understandings, and communications.
  • Severability. If any provision of these Terms is found by a court or arbitrator to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
  • No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. A waiver is effective only if made in writing and signed by us.
  • Assignment. We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer yours without our prior written consent.
  • No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights, except as expressly stated in Section 17 (Apple App Store Terms).
  • Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
  • Survival. All provisions that by their nature should survive termination will do so, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and this section.

21. Changes to These Terms

We may revise these Terms from time to time to reflect changes in the Service, legal requirements, or business practices.

  • Material changes — We will notify you via email and/or a prominent in-app notice at least 30 days before the changes take effect. Material changes include modifications to subscription terms, dispute resolution, or liability provisions.
  • Non-material changes — Minor clarifications or formatting updates may be made without advance notice but will be reflected in the updated "Effective Date."
  • Continued use — Your continued use of the Service after the effective date of revised Terms constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
